Avoiding IRS Trouble With the Help of a Tax Attorney

Is it right for an individual to grow marijuana on his or her property? Two Colorado IRS lawyers, Mark Hinshaw and Raymond Smardon, recently wrote a paper in regards to this very question. They argue that a qualified Colorado marijuana attorney should be consulted if one is growing on their personal residence. Both lawyers agree that although the state legalized medical marijuana in January 2021, Congress passed an act in July called the Compassionate Access to Medicinal Marijuana Act that basically preempts the federal law.

According to IRS Lawyer Hinshaw, the IRS is not targeting small-time cannabis entrepreneurs. He stated that he empathized with companies attempting to run legitimately under state law without succumbing to the IRS. However, unlike the Department of Justice or the Drug Enforcement Administration, which are theoretically in control of who they will prosecute and how they will do it, the IRS does not have the authority to just ignore 28C, according to Hinshaw. He shared with Law News Daily a three tips for taxpayers facing wage garnishment due to federal tax problems. He explained that if one is having trouble making their monthly mortgage payment, is in default of their lease agreement, has judgments against them or is behind in their taxes, they may be eligible for a tax debt relief and petition from the Tax Court.

Hinshaw and Smardon recommended contacting the office of the controller in your state to determine if there are any tax liens or tax arrears against your property. When the controller receives your request for verification, they may ask you to appear in court to review the case. If you meet the criteria for hardship, you should file a written statement with the Denver IRS lawyers indicating your inability to pay your current mortgage. Hardship means a situation where you need immediate financial assistance, while other cases of hardship indicate an inability to pay your current mortgage, due to circumstances beyond your control. After reviewing your financial situation and determining that you qualify, you should file an application with the Denver tax lawyers for a tax lien release.

While the Denver tax attorneys are knowledgeable about tax liens, they are not proficient at negotiating the terms of a release. Hiring a tax attorney does not guarantee a successful outcome; if you hire a tax attorney with no experience dealing with the IRS, you may be stuck with a lot of paperwork and not resolution of your problem. Do not pay money to a tax attorney without first ascertaining whether they have experience with the IRS. When paying money to someone for services they claim they will provide, you want to be sure that you have checked out references. The IRS will not offer references to anyone they do not know. It is wise to interview possible tax attorneys before agreeing to retain their services.

Another reason to avoid using the services of Denver tax attorneys is that they tend to be expensive. While many taxpayers find them helpful, many find they are too pricey. In these tough economic times, many taxpayers cannot afford to pay high fees. In many cases, the only solution is to work with an honest and competent Colorado tax attorney who can help you resolve your tax problems.

There is nothing wrong with hiring a tax lawyer. When tax issues arise that are beyond your control, an experienced professional can assist you in working with the IRS. At the same time, a competent Denver tax lawyer will be there to guide you through every step of the process. The IRS can be difficult to deal with, so many taxpayers simply opt to work directly with the IRS to solve their problems. While working with an honest minneapolis tax lawyer can make dealing with the IRS easier, it is ultimately up to you to decide if hiring one is worthwhile.
